These conditions apply only to the services which form all or part of your holiday arrangements that Florida Villa Co has agreed to supply. They do not in any way define your rights, and or obligations in relation to services provided by another person or company which you may use as part of your holiday arrangement.

Reservations and Payment
Your reservation may be made in writing or by telephone, and must be accompanied by a 25% deposit or full payment if the reservation is being made within 10 weeks of departure.

The submission of a booking constitutes acceptance of these conditions by the client including late booking by telephone or email. Following the receipt of the booking and the appropriate payment, confirmation of reservation will be sent.

Refundable Security Deposit
At the time of full and final payment will be refunded less any long distance telephone charges, excess cleaning costs and replacement or repairs for damage to the property of any of its contents.

In some cases these deposits are taken upon arrival in the USA usually by the Management Company, in the form of a Credit Card 'imprint', although some require a cash deposit. You will be advised of the situation in your particular case prior to your departure.

Changes or Cancellations by Clients
If the client does not pay the balance fee at the prescribed time, we reserve the right to cancel the booking. In this event, or if the client cancels after booking is confirmed, the deposit will be forfeited. Cancellations must be made in writing. Additionally if cancellation occurs within 35-42 days before arrival, 50% of the total holiday cost will be charged, thereafter the total cost will be forfeited by the client.

If you wish to amend your booking we will endeavor to carry out changes, although an administration fee not exceeding £25 per person may be levied, depending on the scale and nature of the changes. It is important that, should you wish to change the number of the occupants, you first check that the accommodation is suitable and licensed for the additional guests, whose names must then be supplied and added to the booking form. Unauthorized over-occupancy is an offence and could result in eviction of the entire party from the property.

Changes or Cancellations by Owners
Whenever possible all changes will be advised to you without delay. Should circumstances beyond our control require us to cancel a booking, we will where possible make alternative arrangements. Should these prove to be unacceptable and once instruction has been receive in writing, you will receive a refund. This does not apply to changes made by management companies, who will not guarantee a specific address.

Liability
We cannot accept liability for the acts or omissions of our principals over whom we have no control such as rental management companies and property owners, or for whom we act in our capacity as agents. The property owners have stated in their agreement with us that they cannot accept any liability for any injury sustained whatsoever by guests or any other visitors to their home or swimming pool, or any loss or damage. However, we are not always able to control all the components of the facility and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we cannot accept liability.

The party must treat the property, its furniture, fittings, utensils, and other facilities with all due respect and should leave the property in a clean and tidy state to enable the cleaners to carry out their job efficiently. Furniture should not be moved around within the property without seeking permission from the management. The applicant is responsible for any damage or physical injury caused during the moving of the furniture. Items of equipment/furniture must never be removed from the house to the pool area or to another property.

Any loss or damage must be reported immediately to the management company. Applicants must make good or pay for any loss, damage or breakage or the appropriate sum will be deducted from the applicants security deposit. Where the justification for the stoppage is disputed, we will endeavour to mediate, but ultimately matters must be settled between the parties concerned. The owners, Management Company or their agent will not be liable for any loss or delay or their reservation caused by conditions over which we have no control.

Force Majeure
Circumstances outside our control include, but are not limited to war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions.

If cancellation or curtailment of your holiday occurs as a result of circumstances beyond our control, the consequences of which could not have been avoided even with all due care, we cannot make any refunds or pay compensation nor be responsible for any costs and expenses incurred by you as a result.

Insurance
The client is strongly advised to take out adequate insurance cover.

We are not responsible for any deaths, injuries, illness or loss or damage to property including motor vehicles or to that of any guest however caused.

This Site
This site is a guide to the quality and description of the properties, but the layouts may vary. We reserve the right to make modifications, which are shown to be necessary in the light of our operating experiences. In the event that unintentional errors, mistakes or omissions occur, we can not accept liability for these details.

Complaints
Our homeowners management companies will always do their best to ensure that the homes are clean and tidy upon arrival of our guests. It is essential however that any defect or shortage is reported to them immediately, in order that the problem can be solved as quickly as possible. Retrospective complaints about which we had no prior knowledge will not be considered under any circumstances.

Any dissatisfaction with the property must be first discussed with the Management Company and reasonable opportunity given to enable them to rectify any shortcomings. If the problem remains unsolved you should then contact this office to make us aware of the situation. Persistent complaints should be put into writing and registered with this office immediately after you return.

Clients Responsibility
All clients undertake to behave with propriety and in such a manner as in no way to cause damage, distress, danger or annoyance to other clients, neighbors, property and/or any other third party. The owner, Management Company or their agent will not be liable for any loss due to noise or disturbance from anywhere within the vicinity of the rental property, including new construction work which could unexpectedly commence.

Similarly, please remember that your villa is probably located in a residential area and late night noise and rowdiness may result in complaints or even a visit from the local police who have powers of eviction. In the unlikely event of this happening we can take no responsibility for providing alternative accommodation. A client in breach of this clause will be considered to have terminated the contract and neither we, nor the providers of the service in question will have any further contractual obligations towards you.

Prices and Surcharges
The minimum rental period is one week. All prices are per week and include utilities and local taxes, unless otherwise stated. Additional days are calculated at one sixth of the weekly rate. Bookings falling between two seasons are pro-rated accordingly. Should the pound/dollar exchange rate fall below £1 =$1.60 we reserve the right to increase the prices.
